For nearly a decade, we have focused on the "Reptile Approach” as a method the plaintiff has used to persuade the jury to award large verdicts based on protectionism. Unlike the reptile, psychodrama is used to bring an accident to life in the courtroom and to gain empathy and a sense of corrective action from the jury. Considering recent verdicts in which the plaintiff's attorney has used psychodrama, it deserves attention. This program will discuss psychodrama, how plaintiff's lawyers use psychodrama, and techniques for defense attorneys to counter psychodrama.
